AGREEMENT BETWEEN CUSTOMER AND CaribbeanTG

This Web site is offered to you, the customer, conditioned on your acceptance without modification of the terms, conditions, and notices contained herein. Your use of this Web site constitutes your agreement to all such terms, conditions, and notices.

CARIBBEANTG.COM IS NOT A TRAVEL AGENCY

CaribbeanTG.COM is not a travel agency, wholesale operator, tour company or booking agent. This site provides a technology that allows accommodation providers to communicate special offers directly to you, the consumer. CaribbeanTG.COM will not charge your credit card or take any payment whatsoever in regards to your travel arrangements. CaribbeanTG.COM will not store or save your credit card information on any system managed by CaribbeanTG.COM.

ACCOMMODATION PROVIDER TERMS AND CONDITIONS

By submitting a reservation and using this system you agree to be bound by the lodging providers terms and conditions listed on the "official website" of the lodging provider. By entering a reservation you are required to agree to the terms and conditions, deposit policy and any additional hotel policies shown on the lodging provider's official website. Terms and Conditions will vary from property to property so it is your responsibility to review before submitting a reservation. You are plainly provided the lodging providers official website address and contact information For your convenience ONLY CaribbeanTG.COM summarizes the lodging providers terms and conditions and deposit policy on this website, however when you submit a reservation request you acknowledge you have reviewed the official terms and conditions, deposit policy and any other policy from the official website of the lodging provider.

RESERVATIONS

When you submit a reservation request using this system an email is generated and sent directly to the lodging provider. Your request is encrypted and sent via a secure SSL connection. Once your request has been submitted and confirmed you are bound by the terms and conditions set forth by the lodging provider.

PAYMENT

All charges to your credit card will be made directly by the lodging provider. Neither CaribbeanTG.COM or its affiliates will charge your credit card or take payment in conjunction with your reservation. Your credit card information is not saved or stored on any system run by CaribbeanTG.COM. Rate subject to change until you receive a confirmation from lodging provider. Unless otherwise indicated rates shown do not include local tax or service charge (if any) from lodging provider.

PASSIVE CONDUIT

By using this system you here by acknowledge that CaribbeanTG.COM and its affiliates are a passive communication conduit and neutral party in your travel planning and reservation transaction. CaribbeanTG.COM is a technology provider and online marketing company engaged in promoting travel destinations, not selling lodging services.

NO WARRANTY OF SAFETY

Although we've tried to make the information on this web site as accurate as possible, we accept no responsibility for any loss, injury or inconvenience sustained by any person resulting from information published or linked on this site. We encourage you to verify any critical information with the relevant authorities before you travel. This includes information on visa requirements, health and safety, customs, weather forcasts, accommodations and transportation. By using this system you acknowledge CaribbeanTG.COM or its affiliates or partners are not responsible for your safety while traveling abroad. It is your responsibility, as a consumer, to review travel policies posted at http://travel.state.gov. While we provide information on this site and provide links to third party websites we do not and can not guarantee your safety. We highly recommend all travelers purchase travel insurance to protect your vacation investment, your health and well being and for your family needs should an accident take place. We offer no endorsement or warranty of any destination, weather forcasts, activity or company featured, advertised or linked via this site. CaribbeanTG.COM (owners, company, affiliates and editors) does not assume, and hereby disclaims, any liability for any loss or damage caused by errors, omissions, misleading information or the use of or reliability of information presented on this web site, even if such errors were made unintentionally or as a result of negligency or any other cause.

RESERVATION REQUEST / NOT A CONFIRMED BOOKING

You are submitting a reservation request that needs to be confirmed directly by the lodging provider. This is not a "real-time" booking engine. The lodging provider has 2 business days to confirm or deny your request. When using this system you acknowledge that you are submitting a "real" reservation that includes your credit card number. Should the lodging provider confirm your requested reservation you are bound by the providers policies. Do not submit a reservation request to simply check availibility. You may contact the lodging provider direclty to ask questions or check avialibilty before submiting your reservation through this service. You will receive a confirmation directly from the hotel once/if they confirm your reservation. Should you provide an incorrect credit card number the hotel reserves the right to contact you directly to confirm your payment details or at there discretion cancel your request.

NON RESPONSIVE LODGING PROVIDER

Once you have submitted a reservation the lodging provider has 2 business days to confirm or deny your request. If you do not receive a reply "confirmed" or "denied" after 2 full business days you are no longer bound by the lodging providers terms and conditions. For legal purposes, after 2 business days without a reply you can consider your reservation request null and void. This is to protect you from a non responsive hotel who at a later date beyond two business days confirms your reservation and tries to impose any cancellation or deposit policies.

PERSONAL AND NONCOMMERCIAL USE LIMITATION

This Web site is for your personal and noncommercial use. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products, or services obtained from this Web site.

LIABILITY DISCLAIMER

You agree that no joint venture, partnership, employment, or agency relationship exists between you and CaribbeanTG.COM as a result of this agreement or use of this Web site.

CaribbeanTG.COM's performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of CaribbeanTG.COM's right to comply with law enforcement requests or requirements relating to your use of this Web site or information provided to or gathered by CaribbeanTG.COM with respect to such use.

If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.

This agreement constitutes the entire agreement between the customer and CaribbeanTG.COM. with respect to this Web site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between the customer and CaribbeanTG.COM with respect to this Web site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.

TERMINATION

CaribbeanTG.COM may terminate this User Agreement and these terms and conditions and/or the provision of any of the services at any time for any reason, including any improper use of this site or your failure to comply with these terms and conditions. Such termination shall not effect any right to relief to which CaribbeanTG.COM and its third party providers and distributors may be entitled, at law or in equity. Upon termination of this User Agreement and these terms and conditions, all rights granted to you will terminate and revert to CaribbeanTG.COM and its third party providers or distributors, as applicable.

ASSIGNMENT

You may not assign, convey, subcontract or delegate your rights, duties or obligations hereunder.

SPAM / BULK MAIL POLICY

Pursuant to US Code, Title 47, Chapter 5, Subchapter II, p. 227, any and all nonsolicited commercial email sent to CaribbeanTG.COM, its travel sites and its advertisers posted herein is subject to a download and archival fee in the amount of $500 US per message. Emailing denotes acceptance of these terms. Any email received from you will be deemed as your acceptance of these download and archival contract terms.

Additional terms and conditions may apply to reservations, purchases of goods and services and other uses of portions of this site, and you agree to abide by such other terms and conditions.
